NORRISTOWN — A former Skippack Township supervisor rejected a plea offer from prosecutors and told a judge he wants to go to trial on charges that he sexually assaulted an underage boy in the county.
Nicholas A. Fountain, 39, formerly of Schwendt Lane, appeared in a Montgomery County courtroom on Wednesday for what initially was expected to be a guilty plea hearing. But Fountain had a change of heart and turned down the plea offer that would have capped his sentence at 20 to 50 years in prison if he pleaded guilty to four counts of involuntary deviate sexual intercourse with a child and one count each of indecent assault and endangering the welfare of a child.
“By rejecting that today, we are done negotiating … you understand that?” Assistant District Attorney Lauren Elizabeth Marvel addressed Fountain during a brief hearing.
“Yes,” Fountain responded as he sat next to his defense lawyers Matthew Scott Brittenburg and Andrew Joseph Levin.
Judge Steven T. O’Neill said Fountain’s case will now be scheduled for trial.
Fountain faces a total of 10 counts of involuntary deviate sexual intercourse with a child as well as sexual assault, unlawful contact with a minor, indecent assault of a minor and endangering the welfare of a child in connection with alleged incidents that occurred between 2016 and 2023 when the boy was between the ages of 9 and 16.
Essentially, prosecutors could seek mandatory minimum sentences of 10-to-20 years in prison on many of the charges, and ask that they be imposed consecutively, if Fountain is convicted of the charges at trial. That means Fountain potentially faces more than the maximum 20-to-50 years imprisonment he could have faced if he had accepted the plea offer.
Now that the case will be listed for trial, Brittenburg and Levin informed the judge they intend to file pretrial motions to suppress Fountain’s statement to detectives and to seek dismissal of some of the charges.
Fountain, who resigned as a supervisor after charges were lodged against him in October 2025, remains in the county jail without bail pending his next court hearing.
At the time of his arrest, Fountain, a Republican who was elected as a Skippack supervisor in 2013, was already facing separate charges in Maryland that he possessed child pornography. Fountain is awaiting extradition to Harford County, Md., on charges of sexual solicitation of a minor and solicitation of child pornography in connection with an online sting operation by authorities there, according to court records.
Officials previously explained that Fountain will have to address the Montgomery County charges before he is extradited to face the charges in Maryland.
The local investigation of Fountain began on Sept. 24, 2025, when a juvenile male reported to state police at Skippack that “he had been sexually assaulted over the course of years” by Fountain, who knew the victim’s family and had access to the boy, according to the criminal complaint filed by county Detective Walter Kerr and state police Trooper Michael Prendergast.
The victim told investigators that Fountain touched him in a sexual manner when he was between the ages of 9 and 16 while he was in Fountain’s company on numerous occasions. The inappropriate touching often occurred while Fountain wrestled with the boy while naked, according to the criminal complaint.
“The victim reported that this unwanted sexual touching by Fountain continued to occur very often,” Kerr and Prendergast alleged in the arrest affidavit, adding the touching incidents escalated to other sexual and indecent contact.
“Around this time, the victim reported that Fountain also exposed him to pornography on Fountain’s phone,” Kerr and Prendergast added.
When Fountain was interviewed by investigators on Oct. 4, he admitted to having sexual and indecent contact with the victim, according to arrest documents.
“Fountain admitted this happened on multiple occasions and stated that the last time this happened was just before the victim turned 16 years old,” Kerr and Prendergast alleged.
Douglass (Mont.) detectives assisted with the local investigation, according to court papers.
According to his LinkedIn profile, Fountain was once associated with the Magnolia Children’s Academy in Douglass (Mont.) Township. A graduate of Perkiomen Valley High School and Temple University, Fountain was also once employed as a junior kindergarten teacher at The Goddard School in Skippack from 2007 to 2020, according to his LinkedIn profile.
After news broke about Fountain’s arrest in Maryland, the Skippack Township Board of Supervisors issued a statement on Sept. 25, calling the allegations disturbing and stating that if true, Fountain should resign.
