AG: Londonderry officers justified in deadly shooting after Planet Fitness incident.The New Hampshire Attorney General’s Office concluded Londonderry Police were justified in using deadly force against Calvin Ly-Bishop, 23, almost 15 months ago after an incident at Planet Fitness.Ly-Bishop was shot and killed on Winding Pond Road in Londonderry on Feb.26, 2025, after allegedly firing a gun in a nearby Planet Fitness gym.The officers involved were Sgt.Timothy Moran, Detective Marvin Alfaro and Officer James DeFelice.Ly-Bishop was armed with a pistol when he exited his vehicle and refused officers’ commands to drop his weapon, according to Attorney General John M.Formella’s report.After asking the officers to shoot him and pointing his gun at himself, the report says, Ly-Bishop aimed his gun at the officers.Some officers said they saw a muzzle flash and heard a pop.Police fired at Ly-Bishop, who was shot three times in the neck and chest.“It was objectively reasonable for Sergeant Timothy Moran, Detective Marvin Alfaro and Officer James DeFelice to use deadly force to fire upon Mr.Ly-Bishop as it was objectively reasonable to believe that Mr.Ly-Bishop then posed an imminent threat of deadly force to the officers,” according to the report released Thursday.Ly-Bishop was pronounced dead at the scene.No officers or nearby residents were harmed in the exchange.An autopsy conducted by Chief Medical Examiner Jennie Duval revealed the presence of a psychoactive compound found in Ly-Bishop’s blood, indicating that Ly-Bishop had consumed marijuana that day.Ly-Bishop had been working at the local Planet Fitness.His co-workers told police Ly-Bishop had been behaving oddly in the days leading up to the incident.That day, an employee told Ly-Bishop he should go home and an argument followed.The employee told police that Ly-Bishop “sprinted” at him but stopped short of physical contact.After being told to leave, Ly-Bishop went into the employee breakroom.Staff then heard a gunshot, and Ly-Bishop left the room and exited the gym through the front door.An employee reported the incident at about 4:45 p.m.They said they did not know if Ly-Bishop fired his gun accidentally or intentionally.Officers found a 9 mm casing on the floor of the breakroom.Ly-Bishop still had his Glock 19X semiautomatic pistol when he was stopped by police on his way home.No body camera footage Police had quickly staged a traffic stop near Ly-Bishop’s mother’s home after identifying him as the suspect.They pulled him over near the neighborhood entrance at 5 p.m.Ly-Bishop initially complied with officers by pulling over to the side of the road, the report says.Police used a loudspeaker to issue orders to Ly-Bishop.The officer in the vehicle closest to Ly-Bishop, Sgt.Moran, had his weapon drawn.Eventually, Ly-Bishop stepped out of his vehicle with the pistol in his hand.He pointed the gun into the air and fired a shot, then he placed the barrel to his head while telling officers he wanted to die, according to the report.Police said they were concerned about the safety of bystanders.Vehicles were backing up near the scene, several yards away from Ly-Bishop’s car, according to the report.“At one point, Mr.Ly-Bishop squatted down and pointed his pistol towards his chin, prompting Detective Alfaro and Officer DeFelice to plead with Mr.Ly-Bishop not to pull the trigger and assuring Mr.Bishop (sic) ‘We can talk through this’ while telling him to put the pistol down,” the report says.Ly-Bishop then aimed his gun toward the group of officers, with all three officers seeing a white flash.They shot at Ly-Bishop, killing him.The officers involved in the incident were not wearing body cameras, according to the report.Londonderry Police only started utilizing body cameras after the March 2025 town elections, the report says.“There is no cruiser camera footage of this incident, and footage from a privately owned delivery truck stopped far back in the line of traffic behind the event did not capture audio or video of the event itself.No civilian or third-party recordings of any part of this incident are known to exist,” the report says.The investigation report compiles interviews with four officers involved in the incident, three of whom fired their weapons.They were interviewed between Feb.27 and March 12, 2025.The report says police recovered only two bullets from Ly-Bishop’s gun — one was found at Planet Fitness, the other at the Winding Pond Road scene, which may have been fired into the air.The report notes Ly-Bishop’s gun had a light system mounted on the front of the barrel.No criminal charges will be filed against the officers in connection with the shooting.
