A judge on Monday maintained bail at $374,000 for a 37-year-old Hilo man accused of multiple offenses in three separate incidents within a 24-hour period last week.
Hilo District Judge Kanani Laubach ordered Lake Charles Kalei Lively to return to court Wednesday for a preliminary hearing.
Lively is charged with first-degree terroristic threatening, four temporary restraining order violations, two counts each of first-degree burglary and being a felon in possession of a firearm and/or ammunition, fourth-degree theft and harassment by stalking.
The most serious offenses, first-degree burglary and felon possessing a firearm are Class B felonies that carry a maximum sentence of 10 years imprisonment, upon conviction.
Laubach denied a request by Deputy Public Defender Paul Billinson to free Lively on supervised release — a form of cashless bail — or a reduction of his bail by half, a motion which was objected to by Deputy Prosecutor Olivia Stevens.
While denying the defense motion, Laubach took judicial notice to a current case in Hilo Circuit Court in which Lively is charged with unauthorized entry to a dwelling, a Class C felony that carries a potential five-year prison term, and the lesser charges of harassment and trespassing. Lively was free on $25,000 bond in that case when the current alleged offenses occurred.
According to police, officers responded at 11:30 p.m. Sept. 16, to a residence in the 400 block of Iloko Street in Hilo following a report of a man making threats while in possession of a firearm. Lively fled the area on foot when officers arrived, police said.
Officers located Lively and took him into custody at 7:22 a.m. Thursday in the 600 block of Ponohawai Street, police said. Detectives from the East Hawaii Juvenile Aid Section identified Lively as a suspect in three separate criminal investigations initiated within the prior 24 hours, which allegedly involved multiple TRO violations and terroristic threatening involving a firearm.
Lively remains in Hawaii Community Correctional Center in lieu of bail.
