Luzerne County prosecutors have declined to pursue charges against a Wyoming Borough man accused of forcibly raping a woman outside of a Mountain Top bar last year.
Thomas Joseph Quinn II, 29, was accused of forcing himself on a woman outside Wheels Bar & Grill at 5222 Nuangola Road in Nuangola on Nov. 23.
The complaint alleged that Quinn raped the woman after she entered his pickup to talk and that Quinn fled the area after two bystanders came to the woman’s assistance.
Rice Twp. police charged Quinn with rape, involuntary deviate sexual intercourse with forcible compulsion and sexual assault.
However, prior to a dispositional hearing last week, prosecutors filed a notice of disapproval of the charges, saying they would not pursue the case because it “lacks prosecutorial merit,” according to court records.
The one-page filing did not offer any further explanation.
Quinn had been free on $100,000 bail that he posted via a bondswoman the day after his arrest.
