BRECKENRIDGE — Two men are facing felony drug charges after Breckenridge police responding to a report of suspicious activity at Park Manor found methamphetamine and drug paraphernalia during an investigation, according to criminal complaints filed in Wilkin County District Court.
John E. Wymore, 43, of Wahpeton, was charged with one count of third-degree possession of 10 grams or more of a narcotic drug other than heroin or fentanyl and one count of third-degree possession of methamphetamine in a school, park or public housing zone. Both charges are felonies.

Patrick Frank Foley, 42, of West Fargo, North Dakota, was charged with one count of third-degree possession of methamphetamine in a school, park or public housing zone, a felony, and one count of giving a court official a false name or date of birth, a misdemeanor.
According to the complaints, a Breckenridge police officer was dispatched to Park Manor on July 13 after a caller reported three men attempting to gain entry to the building. Officers found three men outside the main entrance who matched the description provided by the caller.
Court documents state one of the men admitted he had tried to enter the building. Officers identified Wymore by his North Dakota driver’s license and another man by his North Dakota identification card. The third man identified himself as Jacob Michael Peterson and provided a date of birth, but dispatch could not locate a record matching that identity in North Dakota or Minnesota.
Police later identified the man as Foley and arrested him after determining he had provided a false name, according to the complaint.
The complaint states officers found several small plastic bags, three broken meth pipes, and other drug paraphernalia while searching Foley’s belongings.
Police then searched Wymore after he consented to the search. According to court documents, officers found two plastic bags containing a crystal substance that field-tested positive for methamphetamine. Wymore told officers he had used methamphetamine overnight and said he had about 35 grams.
After completing the search of Wymore, officers continued searching Foley’s belongings and found a six-pocket organizer containing a plastic bag with a crystal substance. Another plastic bag containing a crystal substance was later found in Foley’s pocket during booking at the jail, according to the complaint.

Field tests on the substances recovered from Foley tested positive for methamphetamine. Court documents state the two bags recovered from Foley weighed a combined 3.7 grams.
The complaint states officers weighed the two bags recovered from Wymore at 4.2 grams and 27.5 grams, for a combined weight of 31.7 grams. A field test on the crystal substance was positive for methamphetamine.
According to the complaint, Foley told officers the bag containing the smaller plastic bags came from people giving him used bags. He also said he did not know Wymore had methamphetamine and denied selling methamphetamine.
Both men made their initial appearances on July 14 in Wilkin County District Court.
