Commission dismisses Allen County Democrats

A state commission has dismissed a complaint filed by the Allen County Democratic Party leader against Senior Judge Wendy Davis for her political actions preceding the primary.The Indiana Commission on Judicial Qualifications notified Davis of its decision in a five-sentence letter dated Thursday.Chad Wierzbinski, the local Democratic Party chairman, in a statement Monday thanked the commission for looking into the situation.Davis reportedly hosted a March fundraiser for Ewelina Connolly, a Republican running for Allen County commissioner, and a photo of the two was posted online.Wierzbinski, who had asserted that breaks ethical standards required of judges, said he accepts the outcome of the complaint.“We respect the decision and consider the matter closed,” Wierzbinski said.“(The Allen County Democratic Party) will continue to strive for accountability from public officials via all available processes.” The commission did not provide an explanation for its decision, noting it was among 234 complaints also dismissed at its last meeting.Davis and the Allen County Republican Party chair have said the rules the complaint referred to are for full-time judges.Indiana court rules do not allow judges to publicly endorse or raise money for political candidates or identify with a party, all of which were included in Wierzbinski’s complaint.The Indiana Supreme Court appointed Davis as a senior judge two years ago.Such judges allow courts to use the services of retired or former judges to supplement judicial resources.That includes replacing a regular judge in their absence or overseeing the processing of certain cases or court programs.Davis previously served as a judge in both the Allen Superior Court criminal division and Allen Circuit Court.She resigned in 2023 to run for Congress in Indiana’s 3rd District but lost in the 2024 Republican primary to Marlin Stutzman.Steve Shine, the local Republican Party leader, in a news release described the complaint as a “blatant attempt to smear Judge Davis’s character and reputation.” He said it was likely tied to her possible run for a city office next year.Davis in February launched an exploratory committee to possibly pursue an unnamed local office.“Wierzbinski owes Judge Davis and the community an apology, as well as an apology to the Indiana Supreme Court’s Commission on Judicial Qualifications for wasting their time in an attempt to advance his goal of scoring political points,” Shine said.
